Magic Stories Ambassador Program - Terms and Conditions

Please read these terms and conditions ("Terms") carefully before participating in the Magic Stories Ambassador Program ("Program"). By participating in the Program, you agree to be bound by these Terms, which form a legally binding agreement between you and Magic Stories ("Company"). If you do not agree to these Terms, you may not participate in the Program.

1. Eligibility: The Program is open to influencers, ambassadors, and cosplay heroes who are at least 18 years of age and have an active social media presence. Employees of the Company, their immediate family members, and persons living in the same household are not eligible to participate in the Program.

2. Program Tiers: The Program offers two tiers of participation:

   a. Ambassador Magician: As an Ambassador Magician, you will receive a personal promo code that provides a 10% discount to your audience. For each purchase made using your promo code, you will earn a $10 commission. Additionally, you will receive a special ambassador promo code granting you a 50% discount on all our products.

   b. Affiliate Wizard: To become an Affiliate Wizard, you must register as a partner on the Squaredance platform at **https://partners.squaredance.io/signup/referral/c_LhedD8rf-7?s=a2**. As an Affiliate Wizard, you will earn a $15 commission for each purchase made through your referral link.

3. Commission Payments: Commissions will be paid on a monthly basis via the payment method specified in your account settings. The Company reserves the right to withhold payment of commissions if it reasonably suspects fraudulent activity or violation of these Terms.

4. Promotional Material: You are responsible for promoting Magic Stories products in a manner that complies with applicable laws, regulations, and guidelines. You must not make false or misleading claims about our products or engage in any conduct that could be deemed harmful to the Company's reputation.

5. Intellectual Property: You acknowledge and agree that the Company retains all rights, title, and interest in its trademarks, logos, and other intellectual property. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Company's trademarks, logos, and promotional materials solely for the purpose of promoting the Program, subject to these Terms.

6. Termination: The Company reserves the right to terminate your participation in the Program at any time and for any reason, including but not limited to a breach of these Terms. Upon termination, you must immediately cease using the Company's trademarks, logos, and promotional materials, and any outstanding commissions will be forfeited.

7. Indemnification: You agree to indemnify, defend, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your participation in the Program or your breach of these Terms.

8. Limitation of Liability: To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from your participation in the Program.

9. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the country in which the Company is registered, without regard to its conflict of law provisions.

10. Amendments: The Company reserves the right to modify or update these Terms at any time and for any reason, with or without notice. Your continued participation in the Program following any changes to these Terms constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for any updates or changes.

11. Relationship: Your participation in the Program does not create any employment, partnership, agency, or joint venture relationship between you and the Company. You are an independent contractor and are solely responsible for any taxes, insurance, or other legal requirements associated with your participation in the Program.

12. Confidentiality: You agree to maintain the confidentiality of any non-public information related to the Program, including but not limited to commission rates, promotional materials, and customer data, and not to disclose such information to any third party without the Company's prior written consent.

13. Severability: If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the invalid or unenforceable provision shall be deemed replaced by a valid, enforceable provision that most closely matches the intent of the original provision.

14. Entire Agreement: These Terms constitute the entire agreement between you and the Company with respect to your participation in the Program and supersede all prior or contemporaneous understandings, agreements, or communications, whether written or oral, regarding the subject matter of these Terms.

15. Waiver: The failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision, nor shall any waiver of any breach or default of these Terms be deemed a waiver of any other right, breach, or default.

By participating in the Magic Stories Ambassador Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
